Moon Crest Tech Terms of Service

1. Using our website

Our website is for general information about our services. You agree not to misuse it. For example, don't try to break it, hack it, overload it, or copy large parts of it.

The statistics on our website come from outside research, and we link to each source. They describe general trends. They are not a promise of what will happen for your business.

2. Working with us

When you become a client, we'll sign a written service agreement with you. That agreement explains the exact work, prices, and dates. If the agreement and these terms ever disagree, the agreement wins.

3. Our plans

• Standard Plan: a flat monthly fee plus a one-time setup fee. We tell you both prices before we start.
• Partner Plan: a smaller monthly fee plus a share of the new revenue our system brings in. Before we start, we agree in writing on your starting average revenue (your "baseline") and the exact percentage. We only take a share of revenue above that baseline.
• Reports: each month, we send you a report showing the leads, deals, and new revenue from our system.
• Checking the numbers: on the Partner Plan, you agree to give us the sales information we need to measure new revenue. Each side can ask to review how the numbers were worked out.

4. Payments

You agree to pay on time, as set out in your service agreement. If a payment is late, we may pause your services until it's paid.

5. Cancelling

• You can cancel anytime by giving us 30 days' notice in writing. Email works.
• Monthly fees, and on the Partner Plan your revenue share, still apply during those 30 days.
• Setup fees are not refunded.
• Any sales you make after your cancellation takes effect are 100% yours. We don't take a share of them.
• We may also end our services with 30 days' notice, or right away if you break these terms or don't pay.

6. Your data when you cancel

When your cancellation takes effect, we send you a copy of the data we collected for you, like your contacts and records. Then we delete it, along with the systems we set up for you, from our side.

7. Websites we build for you

If we built a website for you, you can choose one of these when you cancel:

• Buyout: pay a one-time buyout fee, and we hand over your website so you can host it anywhere. You get the pages, design, words, and images. The behind-the-scenes tools are not included: forms, booking calendar, chat and phone helpers, automatic follow-ups, and tracking.
• Deletion: we delete the website.

We'll tell you the buyout fee when you ask. If you don't choose the buyout before your cancellation takes effect, we delete the website.

8. No guaranteed results

We work hard to help your business grow, but we can't promise specific results, like a certain number of leads or sales. Results depend on many things outside our control.

9. AI helpers

Our AI chat and phone helpers always tell people they are AI. AI can sometimes make mistakes, so please check important information. Conversations with our AI helpers may be recorded and stored, as explained in our Privacy Policy.

10. Tools from other companies

Our services use tools from other companies, such as GoHighLevel, Google, and Microsoft. Their own terms apply to those tools. We're not responsible if another company's tool stops working or changes.

11. Who owns what

Our website, content, logo, and the way we build our systems belong to Moon Crest Tech. The illustrations on our website are used under license from Storyset. You keep ownership of your own business information and data.

12. Limits on our responsibility

Our website and services are provided "as is." To the fullest extent the law allows, we are not responsible for indirect losses, like lost profits or lost data. If we are ever responsible for a loss, the most we'll owe is the amount you paid us in the 3 months before the problem happened.

13. The law that applies

These terms follow the laws of the State of New Jersey. Any dispute will be handled in the courts of Camden County, New Jersey, unless the law says otherwise.

14. Changes to these terms

We may update these terms from time to time. When we do, we'll change the "Last updated" date at the top. For current clients, big changes to price or cancellation terms only apply after we tell you in writing.
